Minneapolis, January 13, 2012 – In a victory for the Firm’s client, Marvin Fabyanske and Matthew Collins obtained a $13.2 million Arbitration\u00a0<\/span><\/span>Award on behalf of an ethanol plant in North Dakota. The client,\u00a0<\/span>a 130 million gallon annual producer, sought recovery for damages\u00a0<\/span>incurred as a result of a failed system to dry distillers grains, a\u00a0<\/span>co-product of ethanol production.<\/span><\/span><\/p>\n

The arbitration proceeding commenced and co-chaired by\u00a0<\/span>Messrs. Fabyanske and Collins involved claims for breach of\u00a0<\/span>contract, breach of warranty, and negligent misrepresentation. The\u00a0<\/span>claims were made against a German manufacturer and supplier\u00a0<\/span>of drying technology that was represented by the largest law\u00a0<\/span>firm in the world.<\/span><\/span><\/p>\n

The two week arbitration proceeding occurred after almost two years\u00a0<\/span>of pre-hearing litigation. Leading up to the hearing, Messrs.\u00a0<\/span>Fabyanske and Collins successfully defended against numerous\u00a0<\/span>pre-hearing discovery and dispositive motions filed by the German\u00a0<\/span>company and its lawyers seeking to dismiss the claims of the\u00a0<\/span>Firm’s client. Other activities involved in the case included an\u00a0<\/span>arbitration panel site visit to the ethanol plant, the filing of 100s of\u00a0<\/span>pages of written witness statements, the presentation of direct\u00a0<\/span>and cross examination testimony of 24 fact witnesses and nine\u00a0<\/span>expert witnesses, and management of a one million document\u00a0<\/span>database.<\/span><\/span><\/p>\n
